The Court of Appeal in the National and State Houses Election Petition Tribunal, sitting in Lagos State on Tuesday, ordered the Independent National Electoral Commission (INEC) to allow Hon. Sola Osolana, the candidate of the Peoples Democratic Party (PDP) in February 25th Agege Federal Constituency Election for Federal House of Representatives , to inspect all electoral materials used and unused, information extracted from the card reader machines otherwise known as the Bimodal Voter Accreditation System (BVAS) used for the conduct of the said election in all 11wards in Agege Federal Constituency.
Initially, Hon. Sola Osolana had filled a Motion Exparte dated 10th March, 2023 urging the Tribunal to give him access to all the electoral materials used and used in the said election and most importantly, the Bimodal Voters Accreditation System machines.
During the hearing of the application on Monday, 13th March, 2023, Hon. Sola Osolana’s lawyer, Akinwole Okenile Esq, prayed the Tribunal to grant leave to the Applicant/his agents/the Applicants’ Forensic Experts, to inspect, scan, make photocopies of all the electoral materials to enable the applicant prepare and file his Petition to challenge the declaration in the aforesaid election which was declared in favor of the candidate of the All Progressive Congress (APC).
In the ruling on Tuesday, a three-member panel of the Court of Appeal/Tribunal led by Hon. Justice H. A. Njoku ordered all the prayers sought by the Applicant.
